The process of bringing a civil case to court follows steps established by state or federal laws. Generally, the steps followed by a civil litigation attorney include:
• Filing a summons & complaint stating the grounds for the claim
• Serving a copy of the summons and complaint upon the defendant
• Responding to the answer received from the opposing party
• Engaging in discovery in which the parties exchange documents and other information
• Motions practice wherein each side may file various motions
• And finally preparing for and presenting a trial before either a jury or judge
Some states, such as Arizona, favor the resolution of civil disputes and conflicts through mediation or arbitration. Civil litigation lawyers must be ready to take a case to trial, but they must also be skilled and experienced in other methods of dispute resolution.
